Terms of Use

These terms cover Photostead for iPhone (the “app”), the Photostead server software, and this website, photostead.com, including its demo. They’re published by Atom Tan Studio (“we”, “us”). By using any of them, you agree to these terms.

1. The app

The app is licensed to you, not sold, under Apple’s Licensed Application End User License Agreement (the “Standard EULA”). These terms add to the Standard EULA; if the two disagree about the app, the Standard EULA applies. Apple isn’t responsible for the app or its support; questions and claims about the app go to us.

2. Your server and your content

Photostead works with a server that you or your household runs. Your photos, videos and everything you add to them remain yours. We don’t host your content, can’t see it, and claim no rights to it.

Because you run the server, you’re responsible for it: keeping it running and secure, backing up your library, deciding who has access, and making sure that what you store and share follows the law and respects other people’s rights. Keep a backup of anything you can’t afford to lose; no software or hardware is perfect.

3. Using Photostead well

Please don’t use Photostead, the app or this website to:

• break the law, or store or share content that infringes someone else’s rights;
• access a Photostead server, account or device that isn’t yours without permission;
• interfere with this website, its demo or its hosting, for example by overloading or probing it.

4. The demo

The demo on this website runs in your browser on a sample library. The household, places and events in it are fictional, and its pictures were made with AI for the demo. Changes you make there aren’t saved. The demo is for trying Photostead; please don’t treat it as a place to keep anything.

5. Other services

Photostead can work alongside services you choose to use, such as Tailscale for reaching your server away from home. Those services are provided by others under their own terms, and we aren’t responsible for them.

6. Updates and availability

We work to keep Photostead reliable and improve it over time, which means features may change. We may update the app and this website, and we don’t promise that any particular feature will always be available.

7. Disclaimer

Photostead, the app and this website are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement, to the fullest extent the law allows. We don’t guarantee that they will be uninterrupted or error-free, or that data will never be lost.

8. Limitation of liability

To the fullest extent the law allows, Atom Tan Studio won’t be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising from your use of Photostead, the app or this website. Some places don’t allow these limits, so they may not apply to you; nothing in these terms limits rights you have that can’t be limited by agreement.

9. Trademarks

Photostead and its house-and-lens mark belong to Atom Tan Studio. iPhone, iCloud, Live Photos and Safari are trademarks of Apple Inc., registered in the U.S. and other countries and regions. App Store is a service mark of Apple Inc., registered in the U.S. and other countries and regions.

10. Changes and contact

If we change these terms, we’ll post the new version here with a new effective date. Continuing to use Photostead after a change means you accept the new terms.
